WHAT IS MAINTENANCE?
Maintenance is the financial or material support that a person gives to his or her dependents.
WHO SHOULD PROVIDE MAINTENANCE?
i) Parents to the children
ii) Spouses - One earning more to the one earning less
WHO CAN CLAIM MAINTENANCE
The people who can sue for maintenance when deprived by a person who provides nancial and material support are:
i) Spouses
ii) Children under the age of 18 through their parents or guardians
iii) Children above 18 but still in school.
Note: Under the Matrimonial Causes Act, which is an Act that applies to people who are married under the Marriage Act, Chapter 50 of the Laws of Zambia (statutory marriage), maintenance can be claimed for a child who is below 21 years unless there are special circumstances.
